Justin Timberlake’s DWI Dismissal Hinges on Police Mishap: Cops Made 'Very Significant Errors'

A potential solution may be on the horizon for Justin Timberlake in his DWI case as one of his drinking buddies allegedly drove his car following his arrest.

The former NSYNC member was apprehended on suspicion of driving while intoxicated following a night of revelry with companions at a Sag Harbor, New York, establishment on June 18.

Upon being pulled over, law enforcement officials reported that Timberlake did not pass several sobriety tests and emitted a scent of alcohol. The singer declined to use a Breathalyzer and insisted that he had consumed only a single martini.

According to a recent update by TMZ, the car that Timberlake was trailing returned to the location where he was stopped by law enforcement. Inside the car was a married couple, and the wife stepped out to approach one of the officers, reportedly inquiring, "Are you going to arrest Justin Timberlake?"

Unnamed sources told the outlet that the woman allegedly suggested she would give the "Cry Me A River" singer a ride to their home, where Timberlake was supposed to spend the night.

However, this reported attempt to get the police to let Timberlake go failed as the artist was instead taken into custody.

The outlet's insiders further revealed the woman requested permission from the police to drive Timberlake's rental car to her residence as the singer-dancer was being taken into custody. Without hesitation, the officers granted her request, allowing her to leave in Timberlake's car, the sources claimed.

The unidentified woman reportedly came to The American Hotel two hours before Timberlake showed up. She allegedly indulged in some alcoholic beverages as well, according to the outlet's sources.

However, despite the woman's alleged intoxicated state, the two police officers allowed her to assume control of the car and drive off.

Now, Timberlake's attorney Edward Burke Jr. is working to have his case thrown out. He reportedly plans to present the argument that the two inexperienced officers made a significant error in judgment by allowing an intoxicated individual -- the woman -- to drive off right in front of them.

The lawyer could argue that if their assessment of her was flawed, then they may have made a mistake with Timberlake's arrest as well.

In his plea to the judge, Burke will present this argument as a crucial element of his motion to dismiss the case.

This comes amid Burke's new claim that the "SexyBack" hitmaker was not intoxicated at the time of his DWI arrest.

During last week's hearing, Burke said, per Variety, "The most important fact to know about this case is that Justin was not intoxicated and should not have been arrested for DWI."

"The police made a number of very significant errors in this case... Sometimes the police make mistakes and this is just one of those instances," he added.

According to Fox News, he further said, "The police made a number of very significant errors in this case. In court today, you heard the district attorney try to fix one of those errors. But that's just one and there are many others. Sometimes the police make mistakes and this is just one of those instances."

Timberlake's re-arraignment on the misdemeanor charge is scheduled for Friday.
