Apparently, a last ditch effort to keep Chris Brown out of U.S. Marshals´ custody was to no avail.
Earlier this week, Music Times reported that lawyers were working to keep Brown out of the Marshals' custody.
BET initially reported that Brown's lawyer, Mark Geragos, filed a motion in court to block prosecutors' request for Brown be taken to D.C. under the custody of the U.S. Marshal.
Reports show that the motion was filed April 1.
Brown´s lawyer argued that a Con Air flight would "deprive him of his right to spend necessary time with his lawyer."
According to The Source, a Los Angeles Superior Court judge wasn't buying into it.
"It is the most expeditious and convenient method for all parties," Judge James R. Brandlin said.
A hearing in the motion was set for Thursday (April 3).
Brown is currently awaiting trial following allegations that he attacked a man in Washington, D.C. back in October.
Although he is currently charged with misdemeanor assault, TMZ reports that prosecutors have filed legal docs explaining their reasoning for taking the case before the grand jury.
They believe they have the evidence to support a felony prosecution.
Geragos believes prosecutors attempted to make a mockery out of Brown and test out their system by misusing the grand jury.
Prosecutors claim that the alleged victims sustained injuries serious enough to require hospitalization. They believe that could justify a felony if more evidence is acquired.
