Justin Timberlake is once again dealing with another lawsuit due to copyright infringement of the song "Damn Girl" with Will.I.Am.
Publishing company PK Music Performance filed a lawsuit on Wednesday at the U.S. District of New York, claiming that the song from Timberlake’s album “Futurezex/Lovesounds,” copies “A New Day Is Here At Last” of Perry Kibble, The Wrap reported.
The song, which is performed by J.D. Davis, was originally copyrighted by Perry Kibble in 1969. When Kibble died, the copyright license was renewed with the rights given to his sister Janis McQuinton, a principal of PK Music Performance, who then handed the copyright to the company on December of last year, People reported.
The suit filed by Steven M. Lester from the La Reddola, Lester & Associates LLP, said that Kibble won the 1978 Grammy Award for Best New Artist and was part of the A Taste of Honey band.
Apart from the "Mirrors" singer, other defendants of the lawsuit are Will Adams, who is known as Will.I.am, Sony Music Entertainment and other music distributors and publishers.
"Specifically, a substantial part of the drum, conga drum, organ, bass guitar, electric guitar, and saxophone parts in Damn Girl, were all copied from A New Day Is Here At Last," Lester wrote on the document, according to The Hollywood Reporter.
With that, McQuinton and the company, who discovered the issue in August 2015, is asking for an undisclosed amount and an award for actual damages not only for the sound recording but also for the DVD which contains the live performances of the said song.
The company is also asking that Timberlake and Adam should not distribute or publicly perform "Damn Girl" because of the copyright issue.
This marks the second lawsuit this year for the "Like I Love You singer, who faced one last month for his song "Suit & Tie" when the R&B group Sly, Slick and Wicked claimed to have not received proper compensation.
