Once again, Kesha failed to get out of her contract with her alleged abuser Dr. Luke after the court denied her counterclaims.
The 31-year-old's recent suit was an attempt to appeal a March 2017 decision barring her from filing a countersuit against her alleged abuser. This is only one of the several setbacks from her legal battle against the disgraced record producer whom she accused of raping her in 2014.
Kesha's New Appeal Denied
The court decision, handed on Tuesday, May 29, explains that the proposed amendments by the singer's camp were "insufficient" and "devoid of merit." The Hollywood Reporter was first to break the news.
"Her counterclaim seeking declaratory relief terminating the agreements on the ground of impossibility and impracticability of performance was speculative, contradicted by her own allegations that she had continued performing under the agreements," the decision states, "as to at least one of the agreements, the impossibility was not produced by an unanticipated event that could not have been foreseen or guarded against."
Last year, the New York Supreme Court also sided with Dr. Luke's attorneys who argued that Kesha and her camp should have presented a notice of alleged contract breaches. Moreover, the court noted that the allegations that she could not perform under the existing agreements were based on pure speculations considering that she was able to produce her new album, Rainbow, and was able to tour with Macklemore after the decision was handed.
The court also wants the "Praying" singer to submit documents in possession of Mark Geragos, her publicist and attorney.
"The communications between her counsel and press agents do not reflect a discussion of legal strategy relevant to the pending litigation but, rather, a discussion of a public relations strategy, and are not protected under the attorney-client privilege," the court decided.
Kesha's History Of Abuse Under Dr. Luke
In 2014, way before the #MeToo and Time's Up movements knocked off Harvey Weinstein and other prominent Hollywood personalities from their pedestals because of sexual misconduct, Kesha sued Dr.Luke to void all existing contracts. She accused her former collaborator of sexual, physical, and emotional abuse.
Shortly after, Dr. Luke filed a countersuit, accusing her of defamation.
In 2016, the recording artist received her first big blow when a judge from New York denied her a court injunction that would have allowed her to record new music apart from Sony Music and Dr. Luke while the suits proceeded through the courts.
Dr. Luke Seeking $50 Million In Damages
Meanwhile, The Blast reports that Dr. Luke has filed a new document saying that his involvement in the ongoing legal battle has cost him millions of potential revenue. The record producer is now seeking $50 million in damages after Kesha allegedly defamed his good name through the sexual assault charges.
He said that, because of the accusations of abuse, he lost the chance to earn $29.9 million as a producer and in publishing fees. He also missed the chance to work on Katy Perry's fourth, fifth, and sixth albums.
Following Kesha's accusations of abuse, several celebrities including Adele, Ariana Grande, Lady Gaga, Demi Lovato, Taylor Swift, and Lorde have all voiced their support for the pop star.
