According to the prosecutor, the charges against the individual accused in the hit-and-run death of a Taylor Swift fan will be upgraded to felony murder.

Alan Hayes, age 34, remained in jail on $120,000 bail for DWI and failure to halt and render aid at last check.

On Friday night, police say Hayes struck and killed 20-year-old Jacob Lewis, who was returning home from a Taylor Swift concert with his sister.

According to Houston police, when their vehicle broke down on the Southwest Freeway, Lewis was attempting to push it to the median when he was struck by a vehicle.

They reported that Hayes fled the scene, but a tow truck driver followed him and provided 911 with his location. A few days prior to the accident, Hayes was arrested in Montgomery County on a drug allegation, according to prosecutor Kelly Marshall.

Marshall stated that he admitted that he was afraid.

According to her, Hayes also confessed to mixing alcohol and prescription drugs the night Lewis was murdered. Steve Lewis, the father of the victim, reacted to the information that Hayes had prior convictions. He said he does not have ill will, but he's sad and a bit confused.

The fact that his son shared a wonderful memory with his sister during his final hours of life brings him solace. Jacob's final Twitter post was a concert video with April.

Taylor Swift fans have raised the total of a GoFundMe.com account established for the family to over $110,000, according to Lewis. Hundreds of admirers contributed $13 in Swift's honor, her lucky number. Reportedly, the family intends to use a portion of the funds for a Katy ISD scholarship in Jacob's name. 

Swift's supporters have raised more than $123, 000 thus far. Swifties have also distributed friendship bracelets in memory of the youngster who tragically passed away after the concert. Fans of the 'Shake it Off' singer have proved their loyalty not only to the singing superstar, but also to one another.

Several contributions totaling over $123 000 were in increments of $13 and $113, a tribute to Swift's favored number. In addition to the GoFundMe campaign for Lewis' family, Swift admirers have also worn friendship bracelets in his honor.

It remains to be seen if Taylor Swift herself will react and respond.
