Tory Lanez Attempts To Remove Judge Before Sentencing In Desperate Move To Avoid Jail

Tory Lanez is at his wit's end as he and his team attempt to remove Judge David Herriford from the sentencing trial, wanting to replace him with another judge. Judge Herriford was the presiding judge tasked to oversee Tory Lanez and Megan Thee Stallion's highly-controversial trial.

Earlier in 2022, a jury found Lanez to be guilty of shooting Megan Thee Stallion in the feet at a 2020 party in California.

Tory Lanez Delays Sentencing Trial

According to a report, the Canadian rapper makes his one last dire effort to avoid jail time desperately.

Based on Meghann Cuniff's legal newsletter, she revealed that Tory Lanez's lawyer, Matthew Barhoma, asked the California Court of Appeals to "disqualify" Judge David Herriford after rejecting their motion for a new trial.

She revealed that the motion had been filed on May 19, 2023, and has remained "untouched." The said court has remained mum whether they will consider it as it is days away before Herriford gives Lanez his official sentence on Jun. 13, 2023.

Barhoma and Jose Baez, the lawyers of Tory Lanez, claimed that Herriford "wasn't impartial" during the trial, AllHipHop reported.

"I am not prejudiced or biased against or in favor of any party to this proceeding or their counsel," he said in a statement. "All rulings made by me in this action have been based upon facts and arguments officially presented to me and upon my understanding of the law. All statements made by me and all actions taken by me in this proceeding have been done in furtherance of what I believe were my judicial duties."

Tory Lanez Denied of New Trial After Losing First One

After being convicted in 2022, Tory Lanez and his lawyers have been working non-stop to put the rapper out of jail, still maintaining his innocence.

He was found guilty of three counts of felony, including assault with a semiautomatic firearm, discharging a firearm with gross negligence, and carrying a loaded, unregistered firearm in a vehicle.

Lanez begged Herriford to "not ruin" his life for his sentence.

"I've watched 2 district attorneys ... unlawfully misuse their authority to hide and suppress any and all exculpatory evidence that exonerates me or furthers my innocence," he wrote in a new motion claiming he was "robbed and deprived" of a fair trial.

According to the Los Angeles Times, Lanez could face 22 years and eight months in prison, including deportation, since he is a Canadian citizen.
