Sam Asghari's challenge of his prenuptial agreement may result in a change in child support obligations. In essence, if this divorce turns ugly, Britney Spears' children can also be affected, even if their father is not Sam.
This is confirmed by Kevin Federline's lawyer himself to Page Six, raising the possibility of a fight over the assets in Britney Spears' estate.
Page Six has an exclusive interview with Mark Vincent Kaplan on Thursday.
"If she's seeking to modify the child support that she pays Kevin because she no longer has the same degree of ability to pay what she did prior to her divorce with Sam, then that would have to be litigated in the child support court," he says.
Federline's experienced attorney points out that Spears would have to clear a number of obstacles before a judge would find a change to be "appropriate."
According to Kaplan, Spears should not attempt to modify the custody agreement at this time because her boys are practically legally adults and soon won't be entitled for child support.
Sons Sean Preston, 17, and Jayden, 16, are shared by the "Toxic" singer and Federline, 45. "She would be better off just paying it and focusing her energies on the Asghari litigation," Kaplan argues, noting that it would undoubtedly cost Spears more money to take on yet another legal battle.
There isn't much time left before Britney must start paying child support. It won't be two years yet. There would be no incentive to go and dispute it if she just kept paying the child support regardless of the agreement she makes with Sam.
According to a source who spoke exclusively to Page Six on Wednesday, Asghari is allegedly threatening to reveal his estranged wife's "embarassing" secrets in an effort to get her to alter the terms of their prenuptial agreement and give him a larger inheritance.
In response, a representative for the "Family Business" actor, Brandon Cohen of BAC Talent, told us on Thursday that there are numerous accusations that Sam is contesting the prenuptial agreement and threatening to use tapes to take advantage of his ex-wife.
"However, none of these allegations are true because she has never been the target of malicious intent and never will be. Sam has and will continue to be her supporter.
However, it appears from copies of the divorce file Page Six received that he does want to challenge matters involving "spousal support, property valuation, property division, tax consequences, and attorney's fees."
Laura Wasser, a celebrity divorce attorney, has been retained by Spears to fight back, and another insider told us on Wednesday that the Grammy winner's team has "protected" her and that their "parting will be respectful."
