A new directive was issued on Friday, October 27, to the lawyer of Sam Asghari about his and Britney Spears' divorce.
Documents obtained by The Sun show that Neal Raymond Hersh, Sam's attorney, has been asked to file additional documents in the case or submit a request for its dismissal.
At the helm of the Family Law Division, Supervising Judge Shelle Kaufman has urged counsel for the actor to take action to facilitate the progress of their case.
The process for initiating a divorce includes specific steps to ensure the other party is informed. Delivery of both the summons and petition must be made, followed by filing a proof of service with the court. Additionally, a Declaration of Disclosure should also be completed and sent to the other party.
"If you do not want to proceed with this case, you must file a Request for Dismissal with the Court," according to the filing.
Britney Spears still needs to be formally served with divorce paperwork.
November 15 has been designated as the date for a status conference in which the lawyer representing Mr. Samuel must be present at 8:30 AM.
"If you file a Proof of Service or Request for Dismissal before the hearing date listed above, you do not need to participate in this Status Conference," the paper further said.
In addition, should they fail to submit proof of service or request for dismissal, Sam can expect to pay a court fine and have his case thrown out according to related documents.
On August 17, Britney, and her husband's marriage came to a sudden halt as he officially filed for divorce.
The couple had been married just 14 months prior in an extravagant wedding at Britney's home, with many A-list celebrities like Madonna attending the event.
Rumors have been circulating that 41-year-old Britney Spears has allegedly been unfaithful to Sam, but neither party has chosen to comment on the situation yet.
An inside source told ET Online that it all culminated in a massive fight between the two, leading them to eventually going their separate ways. The source also stated that Britney insists she hasn't done anything wrong.
According to sources close to the situation, Sam is now seeking spousal support from Britney and wants her to pay his legal expenses. His lawyer has implied that he may challenge the prenup, which currently holds Britney's assets as not being subject to division upon their divorce. Court documents confirm this stipulation.
