Kodak Black's attorney is requesting the dismissal of his prescription drug conviction, arguing that Tylenol was discovered in lieu of oxycodone during his arrest in July 2022, only a few months after he was booked again.
The 26-year-old rapper, real name Bill Kahan Kapri, was charged with one count of trafficking oxycodone and one count of possession of a prohibited substance.
However, a recent motion to dismiss the case states that tests on the pills revealed they were just regular painkillers from the grocery store.
In addition to filing the motion, which TMZ was able to access, Bradford Cohen, Kodak's attorney, is also leveling a shocking charge against the Broward Sheriff's Office, alleging a cover-up involving FBI Special Agent James Mitchell.
Additionally, the lawyer claims that while the camera was trained on the police officer's gun, a cop was monitoring Kodak and said he was "always ready" in bodycam footage that the prosecutors tried to hide.
In addition, he asserts that despite tests showing the pills to be Tylenol, the tablets were destroyed throughout the process and that no report was ever given by officials.
Cohen is attempting to have the case dismissed completely on the grounds that it was a part of a "coordinated takedown" of his client.
The rapper was only put into a Florida jail a few months prior to being freed on a $250K bond; yet, his attorney has maintained that the artist has won his case.
The rapper's lawyer Bradford Cohen told TMZ back in August that the rapper will no longer be under stringent supervision during his pretrail release in connection with his prescription drug issue.
Kodak and Cohen appeared in court on Monday about Kodak's recent failure to check in with the authorities, which included failing the required pee tests.
Cohen says he was able to convince the judge to lift the strict pretrial monitoring, and the judge complied, raising Kodak's bond from $75,000 to $250,000.
But as a result of this modification, the Pimpin Ain't Eazy hitmaker was required to go through the jail booking procedure once more.
According to his attorney, Kodak was freed from the Broward County jail in less than an hour after posing for a new mugshot and paying the required bond. Because he won't have to check in because of the tight supervision, Cohen views the decision as a win for his client.
Police allegedly discovered 31 oxycodone tablets in Kodak's car when he was first detained in July 2022 and charged with opioid trafficking. This is happening at an intriguing moment since on Sunday night, the Super Gremlin rapper expressed his dissatisfaction on Instagram Live, which alarmed his fans.
The rapper was wanted by Florida police back in February after failing a drug test and going against his bail terms.
At that time, a court approved Kodak's arrest warrant on Thursday, the 25-year-old rapper being brought into custody should deputies come across him.
Two errors made by Kodak, which was recently sued by two victims of shootings, led to the filing of the warrant in recent weeks.
He was expected to report to the agency in early February for a drug test, but he never showed up.
The organization then asserted that he sent in a sample the following week, but the results showed that he had narcotics in his system. Although the exact amount of fentanyl in his system is unknown, it was reported that the test revealed positive results for the drug.
