A lawsuit has been filed against Ice Spice for allegedly violating copyright with her 2023 song, "In Ha Mood."
Ice Spice, real name Isis Gaston, is the target of a lawsuit brought by sound engineer and producer Kenley "Kass the Producer" Carmenate and rapper/songwriter Duval "D.Chamberz" Chamberlain in the Eastern District of New York.
The artists said that Spice and her producer Riot stole the name, beat, lyrics, hook, and rhythmic structure of their 2022 song, In That Mood, without asking for permission or giving them credit in the lawsuit, which was acquired by TMZ and Rolling Stone. "The similarities between In Ha Mood and In That Mood - including the key phrase used in the chorus and repeated in a substantially similar manner numerous times throughout both songs - are such that it is simply not reasonable to believe that In Ha Mood could have been created without having heard In That Mood first," the filing states.
The songs' remarkable resemblance prevents them from being coincidental, the documents hinted.
The artists said that Riot watched them perform the song in New York and that Riot heard their song on the radio.
"Upon information and belief, Ice Spice, Riot, and/or members of their creative teams were present for certain public performances of In That Mood during the relevant time period," they claim. In addition to damages, Chamberlain and Carmenate are requesting at least half of the song's publishing.
The rapper, 24, has not yet replied to the lawsuit but it's highly likely that she would. She is not one to back down on claims against her.
For example, the accusations of colorism don't phase Ice Spice. The 23-year-old, who is light-skinned and of Dominican and Nigerian origin, claimed in a recent Teen Vogue interview that she has benefited from colorism in spite of her quick ascent in the hip-hop industry. She informed the publication that she has seen those opinions but they do not personally bother her.
"I have seen those opinions," she told the publication. "I feel like that's not something personal to me. I feel like that's been the conversation for generations and forever, since the beginning of time."
