Kesha, Dr. Luke Lawsuit Update: Popstar Barred From Using This CRITICAL Evidence

Kesha's ongoing legal headache with Dr. Luke has some recent developments, and it is a significant blow on the popstar's side.

Rolling Stone reported that the appellate court presiding on Kesha and Dr. Luke's defamation war has ruled out that the former cannot use a "critical" piece of evidence in the ongoing case.

The evidence in question is 16-year-old handwritten notes from Kesha's former lawyer about her claims that Dr. Luke gave him "sober pills."

Kesha told her former lawyer Greg Clarick way back in 2006 that the infamous high-profile music producer had given her a pill "to feel better" - before she blacked out and claimed to have been sexually assaulted.

The 35-year-old singer asked the New York court to reverse an initial ruling last October 2021 to let her use the new evidence in the trial.

Last Thursday, the court ruled that Kesha cannot use the said evidence, which she claims to be "critical" to the case, because she found them too late.

If it were accepted as evidence, this would refute the initial claims of Dr. Luke's camp that the "sober pills" allegation was only made in 2013 instead of 2006.

Per the most recent court ruling, the panel said that Kesha's "belated disclosure" of the evidence was too late, considering that the "four years of extensive discovery" had ended with a deadline two years prior.

The New York State Appellate court is one with the lower court on accepting the newly entered evidence. They believed that since it was already in their custody long before, they could have presented them years prior, eventually altering Luke's camp litigation strategy.

The "Tik Tok" hitmaker's current lawyer, Leah Godesky, further revealed that she had only learned about the said evidence when they called on Clarick last October to ensure his availability on trial.

"It would be, I mean, just a complete travesty of justice for the jury to be led to believe Kesha never told anyone about a sober pill until 2013 when we have concrete evidence of her telling her lawyer about it in 2006," Godesky argued.

In 2014, Kesha filed a lawsuit accusing Dr. Luke, whose real name is Lukasz Gottwald, of knocking her with "sober pills" and sexually assaulting her with ten years of alleged sexual, physical, and emotional abuse.

On the same day, Dr. Luke sued Kesha for defamation and breach of contract for allegedly making "false and shocking accusations" about him.
