Cardi B is anticipated to testify in the next trial about allegations that she used a man's distinguishing tattoo on the cover of her debut mixtape. According to the judge, the jurors are actually looking forward to this, believing that they'll be in for some kind of a trial.
Kevin Brophy, Jr. filed a lawsuit against Cardi B in 2017, alleging that she stole his likeness by placing his distinctive back tattoo on the man seen with his head between Cardi's legs on the cover of her 2016 album Gangsta B**ch Music Vol. 1.
He said that having his body art utilized in such a sexual context without his consent caused him "distress and embarrassment."
The trial will commence on August 3, after neither party was able to strike an out-of-court settlement deal.
U.S. District Judge Cormac J. Carney stated during a hearing in Santa Ana, California on Monday that the Bodak Yellow star is expected to testify in person.
"It's showtime," Carney said, reports Rolling Stone. "I don't think this case is a complex case, but I think it's a very interesting case, and it's one I think the jurors would enjoy."
During the hearing, Brophy's attorney requested that Judge Carney revise the statement that will be distributed to potential jurors at the beginning of the jury selection process.
The revised line reads, "Plaintiff alleges that he did not and would not consent to defendants' use of his likeness, and that he is being portrayed in an offensive manner depicting sexual activity with Cardi B."
Cardi's attorney Alan Dowling requested a change to another sentence in the statement, so it now goes like this: (Brophy) is not the man depicted in the image, that the image does not portray actual sexual activity (and) that defendants' use of his tattoo design did not show plaintiff in a false light or would be highly offensive to a reasonable person in plaintiff's position."
This will be the second trial for the rapper this year. In January, she prevailed in her defamation case against YouTuber Tasha K about fraudulent statements made in her videos and was paid almost $3 million in damages and legal fees.
This is not the first time that Cardi B will be in court. She was however, on the other side when it comes to her legal case with YouTuber Latasha Keba -- and she scored a victory. The judge believes that the trial set for August 3 will last four days.
