XXXTentacion's Killer Wants Court To Declare Mistrial After Failing To Depose Drake: Report

XXXTentacion's murderer urges the court to declare a mistrial in the case after a judge did not depose Drake.

One of the suspects in the killing of rapper XXXTentacion, Dedrick Williams, argued that the murder case should be considered a mistrial. He also wants judge Michael Usan, who oversees the case, recused.

In new court documents obtained by AllHipHop, which was filed on Thursday morning, Williams' legal team called out the court for its refusal to depose Drake despite having an integral part in the case due to his infamous beef with the late rapper.

"In the court's denial of that motion to perpetuate testimony, the court indicated for undersigned to 'just take his deposition,'" the filing reads. "The court at that time alerted all counsels and the prosecution that when the deposition takes place, to treat it with the same scrutiny that one would his trial testimony."

The legal team insisted that if Drake, whose real name is Aubrey Drake Graham, was not available to testify, the court would instead use his deposition transcripts.

The court initially approved Williams' request to depose Drake in XXXTentacion's murder case. However, the 36-year-old "God's Plan" rapper's attorney, Bradford Cohen, was able to convince judge Usan to reconsider his supposed deposition.

Due to the judge's decision, Williams wants Usan to be recused.

The convicted murderer's team also accused XXXTentacion's aunt, Deandra Ellis, of lying during her deposition. Williams' representatives noted that the fact that she said she was close to her nephew but did not know about the rappers' beef was unbelievable.

Drake's Supposed Deposition in XXXTentacion's Murder Trial

During the opening statements on Feb. 7 (via Complex), Williams' defense attorney mentioned Drake proved his potential connection to XXXTentacion's murder due to the late rapper's now-deleted Instagram story.

For what it's worth, XXXTentacion said if anybody killed him, it would be Drake.

The two hip-hop artists infamously had beef in 2017. Drake previewed a song during his Amsterdam tour stop. Some concertgoers said the song sounded close to XXXTentacion's hit track, "Look At Me."

From there, the public accused Drake of "biting" other artists' music. While he denied the accusations, XXXTentacion soon released tweets to express his rage.

Drake was scheduled to be deposed on Jan. 27 but failed to appear. He was then ordered by a judge to depose on Feb. 27; a week later, the judge dismissed the order as Drake was reportedly "no longer obligated" to give a deposition.
