Tommy Lee won in a round of the sexual assault lawsuit filed against him.
On Monday, May 6, a California judge dismissed a sexual assault lawsuit against the Mötley Crüe drummer but gave the plaintiff 20 days to file an amended complaint.
According to Rolling Stone, the judge would like to see new alleged facts to support Jane Doe's claims regarding Lee's alleged attempt to conceal the evidence when he allegedly battered her sexually during a helicopter ride in 2003.
In the lawsuit, obtained by TMZ, the accuser said she received an invitation on a tour of San Diego County from the chopper's pilot, whom she was reportedly friends with. However, a change of plan led her to be in the helicopter with Lee and another man instead.
During the flight, Lee and the man reportedly started drinking alcohol and consuming substances. The accuser alleged that she was forced to sit on the musician's lap before Lee began groping and kissing her against her will.
Lee reportedly penetrated her and forced her face toward his private part.
She filed the lawsuit in December 2023, declaring she had suffered different mental health issues and demanding an undisclosed amount of damages from Lee.

However, the judge ruled in favor of Lee's party after his lawyer argued that the claims did not qualify for revival due to the Sexual Abuse and Cover Up Accountability Act. The lookback window for filing claims ended on December 31, 2023.
"The court had its own questions about that," said Los Angeles County Superior Court Judge Holly J. Fujie. "However, this is officially our first look at the pleading, and we will almost always grant one opportunity to amend."
For the ruling, Judge Fujie explained that Jane Doe failed to assert facts to support the 'coverup' requirement." The ruling dismissed four causes of action in the lawsuit - sexual assault, gender violence, intentional infliction of emotional distress and negligence - according to Rolling Stone.
"We applaud the court's decision. The court got it right in finding that the plaintiff cannot assert a claim against Tommy Lee. From the outset, Mr. Lee has vehemently denied these false and bogus accusations," Lee's lawyer, A. Sasha Frid, said in a statement to the news outlet.
