Pandora Cries First Amendment in Copyright Lawsuit with The Turtles
Pandora is continuing its fight against The Turtles and all music artists recorded before 1972. Mark Volmer and Howard Kalen, aka Flo & Eddie, filed suit against the streaming music service in September after their successful lawsuit against SiriusXM. Members of The Turtles want compensation, but Pandora in a recent motion said the band is infringing on the service's First Amendment rights to play the group's music, "Billboard" reports. The issue is that the United States did not have a master recordings copyright law until 1972, so everything recorded before that year has been played on Pandora and SiriusXM without compensation for the artists. Volmer and Kalen decided to try the case at the state level, which worked after a judge in California ruled that the satellite radio provider had to pay up. That is the same judge hearing the Pandora case — the service is hoping to receive a change of venue. The pair also secured a win in November in a New York courtroom.Pandora is now crying First Amendment. -

Swift loved it."My favorite covers are the ones where the artist has made it their own, changing the way the song makes you feel," she tweeted to her nearly 50 million followers along with a video of the performance. -
Brandon Flowers on The Killers: Says Band Suffers from a 'Lack of Drive' and Next Album Will Be 'Different'
Brandon Flowers of The Killers knows why his band is not more successful. In a recent chat with "NME," he said The Killers suffer from a "lack of drive." That is some harsh criticism considering they have two platinum albums under their belt with "Hot Fuzz" and "Sam's Town," as well as strong releases with "Day & Age" and "Battle Born." Flowers cites U2 as a band who was more in tune with their time and generation."There's definitely a drive that we're lacking," Flowers said. "It takes a lot of work and that's fine, everybody's different, everybody's gonna have their own road that they go down. Other than Coldplay I'm not sure anybody's made the dent that U2 were able to make. They were so much a part of the landscape and the timing of when they were coming out."That is a tough comparison. U2's first album came out in 1980 during an era that relied heavily on albums. "Hot Fuzz" was released in 2004 in the midst of a still-changing landscape. -

Everything seems to be back on track for AC/DC. The same cannot be said, though, for the group's longtime drummer Phil Rudd. "'Cause when we were doing the album, one minute he was coming, the next minute he wasn't coming. So it took quite a while to get him to the studio. When he got there, he did a great job. [But] it's not the Phil that we'd known all over the years. He knew that we were promoting the album and doing stuff [like photo and video shoots], and again he said he'd be there and no, last minute, again, he didn't show."Rudd missed his court date earlier this month. A full review of the case will occur Feb. 10. -
